Catering 2u. Order and Hire Terms and Conditions.
- Orders
All orders for food, beverages, sundry items and equipment hire ("Order") placed on this website are subject to the Conditions of Use of this website and these Order and Hire Terms and Conditions.
You must submit your Order no later than 48 hours prior to the start of the Exhibition open period specified in Your Delivery Details. If the Exhibition is due to open in less than 48 hours, please contact Catering 2u to discuss your requirements.
- Prices
All prices are expressed inclusive of VAT charged at a rate of 17.5%. Prices are subject to variation if the VAT rate changes.
If your order consists only of items from the Essential Beverage Collection page, a Delivery Charge will be payable if the order value is below £25 inclusive of VAT.
- Availability
If for any reason beyond our reasonable control, we are unable to deliver a particular item, we will make reasonable endeavours to contact you to discuss suitable alternatives. If we cannot contact you we may deliver a suitable alternative product - however you may reject the alternative and you will not be charged for the undelivered item. Large orders can only be fulfilled at the discretion of Catering 2u as stocks are subject to availability.
- Acceptance
When we process your order and receive your payment (in the case of cheque or credit/debit card payments, this will be deemed to be when funds have cleared), a contract will be formed. You agree that these terms and conditions represent the entire agreement between the Parties relating to your order and that no statements or representations made by either party have been relied upon by the other in agreeing to enter into the contract.
- Delivery
Delivery will be made to the Hall and Stand number at the Exhibition specified in your order. All goods must be signed for on delivery. We will not be liable if we fail to deliver the goods at the agreed time in circumstances beyond our reasonable control.
Any deliveries of alcohol must be signed for by a person over 18 years of age.
- Force Majeure
Catering 2u shall not be responsible for any failure in fulfilling all or any of its obligations under these Terms and Conditions by any circumstance of any nature which is outside its reasonable control.
- Cancellation and Changes
If you want to cancel or change your Order, please contact Catering 2u (see Contact Us page).
- Payment
Payment will be required at the same time that you place your order.
Payment may be made using cheque, Visa, Amex, Mastercard, Diners and Switch.
For payment terms related to the Equipment Replacement Value, see the Equipment Hire section below.
Card payments - We will process your card details and charge your account when we receive your order.
Cheque payments - If you are paying by cheque, please make your cheque payable to The National Exhibition Centre Limited and send it to Catering 2u Catering, The National Exhibition Centre, Birmingham, B40 1NT. We will bank your cheque on receipt.
- Liability
Catering 2u liability is limited to the replacement of the product ordered or the refund of its purchase price. This is the entire liability of Catering 2u and is your exclusive remedy. Catering 2u shall not be liable for any other damages or losses including direct, indirect, special, incidental or consequential damages or loss of profits to you or any third party.
- Food Standards and Hygiene
Unless otherwise requested all sandwiches will be made with butter. All platters will be appropriately garnished. Individual sandwiches are available on request - please contact Catering 2u for further information.
IMPORTANT - Food once delivered to the stand must be handled and stored in accordance with Food Hygiene Legislation - further details available on request - and the NEC Ltd cannot be held responsible for problems resulting from failure to comply. Any complaints must be made at the time of delivery.
PLEASE NOTE - All food must be kept refrigerated and consumed within 3 hours.
Equipment Hire
- All equipment remains the property of the National Exhibition Centre Ltd., registered office NEC Ltd., Birmingham, B40 1NT. ('The Owner')
- The period of the hire is for the duration of the exhibition for which the equipment has been booked.
- The person signing the contract on delivery warrants that he has the hirer's authority to do so.
- Equipment Replacement Value
The hirer shall, without prejudice, to any other right or remedy of the Owner pay a charge equal to the cost of cleaning, repairing or reconditioning or replacing as the Owner considers necessary any of the equipment or any part of it not returned in clean and good condition at the end of hiring. Any such charge fee for replacing any equipment shall equal the Equipment Replacement Value applicable at the end of the period of hire.
- The Equipment Replacement Value is a refundable security payment and must be made either:-
a. in advance by cash or cheque;
b. by Visa, Amex, Mastercard, Diners or Switch when it will be charged on the day that the equipment is dispatched to you.
- Any security for the return of goods paid by the hirer shall be refunded if all hire and other charges have been paid and the equipment has, on inspection by the Owner after it has been returned, and found by the Owner to have been returned in clean and good condition.
- Force Majeure
Catering 2u shall not be responsible for any failure in fulfilling all or any of its obligations under these Terms and Conditions by any circumstance of any nature which is outside its reasonable control. In the event of the completion of the contract being frustrated owing to such circumstances, the contract shall be deemed to be complete and the hirer shall be liable for payment of the percentage of the total contract deemed to have been carried out.
- No variation of these conditions of hire and no conditions in any order or acceptance of the hire shall be effective unless agreed to in writing by the Owner.
- The Hirer undertakes to comply with any safety instructions for the equipment made available by the Owner.
- Unless otherwise stated any price or rate quoted or published by the Owner is inclusive of value added tax at a rate of 17.5%. Prices are subject to variation if the VAT rate changes.
- The hirer is responsible for the safekeeping of all equipment including boxes, racks and cartons from the time of delivery until it is collected or returned to the Owner. For this we recommend you arrange ALL RISK INSURANCE.
